Our Terms and Conditions
Monaco .Safaris (M.S) hereby called the Tour Operator states this agreement to anybody, whether booking directly for himself, herself or /and themselves, or through any agent duly authorized by you (traveller). M.S states that any information and or rates mentioned in this tariff book are subject to change and amendment from time to time. Whoever books any tour on this manual and his or her agents agree that they have read and understood the following terms and conditions

1) About prices
M.S prices include all services stated on any proposal that we send you, in the currency stated and are for the particular period stated on our correspondences. Any other exclusion from the prices will be clearly stated on every specific proposal or correspondence

2) About booking deposits and refunds
(a) Any request for our services can only be confirmed if requested in writing
b) A deposit of an amount requested by a M.S tour consultant or agent at the time of booking shall be payable immediately upon receipt of the invoice
c) We believe that the person(s) making the booking on your behalf is duly authorized by yourselves and warrants that he/she acts on your behalf and with your consent
d) If M.S is unable to confirm any tour as per your requirement, we shall refund your deposit in full. However, if M.S is does not confirm your precise tour, but proposes a reasonably similar alternative prior to your specified date, we will then NOT refund any deposit
e) M.S offers prices according to the prevailing costs at the date of your booking, although it reserves the right to change such prices without notice
f) The total cost of the tour stated on the invoice should be paid so as to appear on M.S financial books not later than 30 days before the commencement of the tour
g) Your tour shall only be considered confirmed after 100% payment of the total invoice
h) You shall indemnify M.S against any claims, costs, demands, and expenses whatsoever, wheresoever made by any of the travellers who may be a minor (minority age is as per Kenyan Laws stipulation)
i) If the payment is received by M.S as requested above, then M.S is bound unconditionally to the price quoted from that time unless the price shall be affected by any other factor beyond the control of M.S in which case, M.S reserves the right to adjust the price accordingly

3) About Accommodation
a) Whereas M.S shall do the best to provide accommodation as per your request with private bathrooms, M.S does not guarantee the availability of private bathroom or single room
b) All single rooms attract a supplementary charge
c) M.S shall do the best to accommodate you in the lodges, camps or hotels of your choice, but reserves the right to alter the accommodation to any substitute lodge, camp or hotel that M.S feels in its own view that the value and quality is of the same standard as the property initially requested
d) M.S shall not be held responsible nor liable in the event is offers substitute services of a property of the same value and price (in M.S view) and you decline to accept it

4) About Cancellation and Amendments
a) Any cancellation or amendment shall be made in writing
b) Any cancellation or amendment done within the period of 40 to 25 days of the commencement date, M.S shall impose a 25% fee on the total invoiced cost
c) Any cancellation or amendment done within the period of 24 to 15 days of the commencement date, M.S shall impose a 50% fee on the total invoiced cost
d) Any cancellation or amendment done within the period of 14 to 0 days of the commencement date, M.S shall impose a 100% fee on the total invoiced cost
e) In case you had paid any deposit, the same will compensate for the respective cancellation or amendment fee as mentioned above
f) If you amend or cancel, any deposit that you make will fist compensate for the respective fees and the balance will be your new deposit towards the tour
g) If you cancel while you had made any deposit, M.S will recover the cancellation fees first applicable to it, then deduct any charges for contracted reservations already made, any cancellation fees charged by hotels /lodges, or any other charges that M.S may have incurred. Then, the balance will be refunded to you
h) If you amend any tour after its arrangement had commenced, we will diligently apply our excellent working relationship with our partners, but M.S reserves the right to charge any fee if the partners charge for the same. In the event partners do not charge, M.S will also not charge
i)M.S reserves the right at any time, and without incurring any liability whatsoever and howsoever to alter any tour arrangements, offer substitute services and facilities in M.S view of equal value and quality, or to cancel any tour. If this is the case, M.S shall make a full refund EXCEPT if such arises from war, threat of war, insurrection, riots, strikes, civil actions, decisions of governing bodies, natural disaster, bad weather, technical or maintenance problems with transport, changes or cancellations of air carriers, and any other force beyond M.S control
 
5) About your responsibilities
a) It is the client’s sole responsibility to obtain all relevant travel documents prior to the travel date
b) It is the client’s sole responsibility to ensure that all travel documents like passports, air tickets, visas, vaccination certificates are in the correct order and names are correctly printed
c) It is the client’s sole responsibility to obtain enough insurance cover against personal accident, medical expenses and loss/damage to your baggage
d) It is the client’s sole responsibility to inform M.S in advance of any special requirements that you may need like special diets, wheelchairs and any other special assistance, although M.S does not guarantee that such requests will be honoured
e) All your belongings and baggage travel at your entire risk

6) About Transportation
a) M.S shall provide safari buses, transfer coaches, four-wheel drive vehicles, and aircrafts that it considers necessary and convenient to you based on the considerations like route conditions, number of passengers to be carried, distances to be covered, and security concerns
b) M.S reserves the right to employ the services of a sub-contractor for your transport needs

7) About MS rights and responsibilities
a) M.S reserves the right to decline or cancel your booking if it considers you as unsuitable for any reasons like age, health and /or security
b) In the event above happens, M.S shall refund your deposit less any respective charges earned 
c) Unless you are travelling in M.S transport means like vehicles and aircrafts, M.S acts only as an agent in all matters relating to transportation whether by air, road, sea or rail
d) M.S shall not be liable for any injury, delay, damage or loss arising from the act or omission of any person, his employee or his agent,  whether acting within the scope of his contract or not in the provision of  transportation, accommodation, or any other services, other than M.S
e) M.S shall accept responsibility of any death, loss, damage or illness caused by the negligence of his authorized employee or agent (other than domestic and international air and sea carrier agents) in the execution of their duty while in the M.S employment.
f) In the event Clause 7 (e) takes place, M.S shall pay damages as might have been claimed irrespective of death or loss caused by the negligence of M.S
g) M.S shall be fully indemnified against any claims except as stated in this booking condition section

8) About Arbitration
a) Any dispute or difference between you (whoever books whether for himself/herself or acting as an agent) and M.S (here referred to as the Tour Operator) relating to the validity or performance of this agreement shall be referred to an Arbitrator who shall be appointed (in default of agreement between us within 21 days of notification of such dispute by one of us to the other by the Chairman for the time being of the Chartered Institute of Arbitrators, Kenya Branch, upon the application of either of us. Such arbitration shall be conducted at a venue in accordance with the Arbitration Act (Cap 49)

9) About Jurisdiction
a) All matters subject to these conditions shall be subject to the laws of the Republic of Kenya. You submit to the exclusive jurisdiction of the courts of Kenya which shall be the sole forum for the hearing of any claims other than those which shall be referred to Arbitration
